  1. Formation/Amendment of Special District
    Step 1. Service Plan: Pursuant to C.R.S. 32-1-201 et.seq. Anyone forming (or amending) a proposed special district is required to submit a service plan that outlines the services that the district will provide. The service plan also provides a financial plan for the procurement of land and facilities that maybe necessary to provide the district services. The service plan must be submitted to the Board of County Commissioners (“the BOCC”) via the Clerk to the BOCC.
  2. Please provide two dates/times you would be available to meet with the Clerk to the BOCC to discuss the components of the application. At this time, please also bring a check to pay for the Clerk & Recorder fees. The amount due is $500.00.

    Step 2. Planning Commission Hearing: Once the Service Plan has been received, it is sent to the County Planning and Zoning Commission for review. The Planning Commission has 30 days from the date of filing of the Service Plan to hold a public hearing and make a recommendation to the BOCC. The Clerk to the BOCC will notify the Petitioner of the date and time of the Planning Commission Hearing. This will happen at least 20 days prior to the hearing date. The Clerk to the BOCC will also provide written notice of the date, time and location of the hearing to the Division of Local Governments and all Municipalities and Special Districts which have levied an ad valorem tax within the next preceding tax year and which has boundaries within a radius of 3 miles of the proposed district. The Community Development fees associated with this part of the process will be determined by the planner and will be approximately $750.00.
  6. Step 3. Notifications by Petitioner: The Petitioner must send postcard notification of the BOCC hearing to property owners within the Service Plan boundary. Notification shall indicate that it is a notice of hearing for the organization of a special district. Its contents shall include the date, time, location and purpose of the hearing, reference to the type of special district, maximum mill levy and procedures for filing petition for exclusion pursuant to 32-1-203(3.5). Petitioners are advised to go to www.pitkinmapsandmore.com to determine who should receive a postcard.

  8. Step 4. BOCC Hearing: The BOCC will hold a duly noticed public hearing to review the service plan and within 20 days of such hearing, the Clerk to the BOCC will advise the petitioner of action on the service plan. If the plan is approved, the BOCC will issue a Resolution of Approval. This Resolution must be accompanied by the Service Plan when the Petitioner files it with the District Court.
  9. Step 5. Election/Court Action: After BOCC approval and a successful election creating the district, the service plan, along with a certified court order organizing the district shall be filed with the Pitkin County Clerk and Recorder and the Division of Local Governments.
